SnapshotChicago.com, hereafter
referred to as Snapshot Chicago, allows its registered
members to submit classic photos of Chicago and create
online photo albums by uploading image files to Snapshot
Chicago servers. As a Snapshot Chicago member you agree
to receive periodic emails from Snapshot Chicago containing
information about new features and service options and/or
information about the status of your photo submissions
and your membership.
Snapshot Chicago is not responsible for content posted
by Snapshot Chicago members. Snapshot Chicago does not
verify or endorse any content posted by its members.
If you believe that any of the content posted by Snapshot
Chicago members or visitors violates your proprietary
rights including copyrights please report it by clicking
on the "Contact Us" link on the Snapshot Chicago
homepage.
As a Snapshot Chicago member you are solely and fully
responsible for any content posted by you or visitors
to your Snapshot Chicago account. Although we review
member content on a spot-check basis, we cannot establish
nor guarantee the legal nature of any such content.
We prohibit the posting of the following content in
any member account:
* nudity, pornography, and sexual material of a lewd,
lecherous or obscene nature or intent or that violates
local, state or national laws.
* any material that violates or infringes in any way
upon the proprietary rights of others including, without
limitation, copyright or trademark rights.
* any material that is threatening, abusive, harassing,
slanderous, defamatory, invasive of privacy or publicity
rights, vulgar, obscene, profane, indecent, or otherwise
objectionable including posting private information
belonging to or about other individuals.
* content that promotes, encourages, or provides instructional
information about illegal activities.
* hate propaganda or hate mongering, swearing, or
fraudulent material or activity.
By submitting your photos to Snapshot Chicago, you
represent that the photos, titles and descriptions comply
with the Terms and Conditions of Use set forth in this
section. If any third party brings a claim, lawsuit
or other proceeding against Snapshot Chicago based on
content you post on Snapshot Chicago, you agree to compensate
Snapshot Chicago including its officers, directors,
employees and agents for any and all losses, liabilities,
damages or expenses including attorney's fees incurred
by Snapshot Chicago in connection with any such claim,
lawsuit or proceeding.
Snapshot Chicago is the final arbiter of what is allowed
and not allowed on the Snapshot Chicago website. If
any content posted by a member is found to be in violation
of the Terms and Conditions of Use set forth in this
section, all that member's content may be removed and
the member will be permanently barred from any use of
the website.
Snapshot Chicago reserves the right to modify or remove
any content in a member account or to delete a member
account at any time without prior notice if that account
violates the Terms and Conditions of Use set forth in
this section Snapshot Chicago reserves the right not
to use a submission at all and/or to use as much or
as little of a photo as they choose
Snapshot Chicago is not responsible for any financial
or personal loss to members using their Snapshot Chicago
accounts for business or any other purpose for any reason
including but not limited to server down situations
and accidental or willful deletion ofmember accounts
and/or contents of said accounts.
Images stored on Snapshot Chicago servers are for online
viewing purposes and not meant for permanent or temporary
archival purposes. Snapshot Chicago will make a good
faith effort to maintain any materials submitted to
the website, but is not obligated to maintain back-up
copies of any submitted or posted material.
Snapshot Chicago is not responsible or liable for any
monetary losses incurred by members using their accounts
for either personal or business, marketing or any other
commercial purpose for any reason including but not
limited to server malfunction, server crashesor software
related problems. Snapshot Chicago has the right to
edit and/or alter any submission. .
By submitting your photos you hereby grant to Snapshot
Chicago an irrevocable, non-exclusive, perpetual, worldwide
license to edit, reproduce, use, syndicate, license,
print, distribute and otherwise exploit the materials
you submit, or any portion thereof, as incorporated
in any of Snapshot Chicago publications or promotional
materials, in any manner and in any medium or forum,
whether now known or hereafter devised, without making
payment to you or any third party. You represent and
warrant to the Snapshot Chicago that you have the full
legal right, power and authority to grant to Snapshot
Chicago the license provided for herein, that neither
the materials nor the exercise of the rights granted
herein shall infringe upon or violate the right of privacy
or right of publicity of, or constitute a libel or slander
against, or violate any common law or any other right
of, any person or entity. You hereby release Snapshot
Chicago from any liability associated with the publication
or distribution of your submission. You agree to indemnify,
defend and hold harmless Snapshot Chicago, their licensees,
successors and assigns, and each of their officers,
agents and employees from all liabilities or losses,
including, without limitation, reasonable attorneys'
fees, arising out of or related to Snapshot Chicago's
exercise of the rights granted herein. This license
shall be governed by the laws of the State of Illinois.
Snapshot Chicago reserves the right to deny submissions
for publication at our discretion.
